Federal

Americans with Disabilities Act of 1990 (ADA), Title III — Prohibits discrimination on the basis of disability by places of public accommodation, including businesses that offer goods and services to the public through websites. (42 U.S.C. §12181 et seq.)
Section 508 of the Rehabilitation Act of 1973, as amended — Requires that electronic and information technology be accessible to persons with disabilities. While Section 508 applies directly to federal agencies, its standards (36 C.F.R. Part 1194) inform best practices for all organizations. (29 U.S.C. §794d)
Section 504 of the Rehabilitation Act of 1973 — Prohibits discrimination against individuals with disabilities by recipients of federal financial assistance. (29 U.S.C. §794)
U.S. Department of Justice Final Rule on Web Accessibility (April 24, 2024) — Establishes WCAG 2.1, Level AA as the technical standard for web content and mobile applications under Title II of the ADA for state and local government entities. Courts are increasingly applying this standard as a benchmark in Title III private business cases.
Web Content Accessibility Guidelines (WCAG) 2.1, Levels A and AA — The technical standard referenced by federal courts, the DOJ, and regulatory bodies when evaluating accessibility compliance for private business websites.

State of Florida

Florida Accessible Electronic and Information Technology Act, §282.603, Florida Statutes — Requires Florida state agencies to develop and maintain accessible electronic and information technology consistent with Section 508 standards and WCAG 2.1 AA. While this statute applies directly to state agencies, EWG voluntarily adopts its standards as a matter of best practice and professional responsibility.
Americans with Disabilities Act — Florida Enforcement — Florida courts and the Eleventh Circuit Court of Appeals have held that Title III of the ADA may extend to non-physical spaces, including websites, where a sufficient nexus exists to a place of public accommodation. Florida has been among the most active states in ADA website accessibility litigation.
Florida Civil Rights Act of 1992, Chapter 760, Florida Statutes — Prohibits discrimination against individuals with disabilities and supplements federal ADA protections within the State of Florida.

3. Conformance Status

EWG aims to achieve and maintain conformance with WCAG 2.1, Level AA across all pages and features of www.ewgrp.org. Our website is built on the Wix platform, which incorporates a range of built-in accessibility features. We recognize that full conformance is an ongoing process, and we are committed to continuous improvement.

Current accessibility features and practices include:
